1. Acceptance of These Terms

These Terms of Use (the “Terms”) govern access to and use of the website available at ilekonsult.no (the “Site”) and any related pages owned and operated by Ile Konsult AS. By visiting, browsing, or using the Site, you agree to be legally bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Site.

You confirm that you are at least 16 years old or visiting under the supervision of a parent or legal guardian. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description and Scope

Ile Konsult AS provides educational information about business education programs, organizational development training, strategic planning workshops, workplace communication modules, and professional development learning paths. Course delivery formats may include online sessions, live workshops, assignments, and guided resources for participants located throughout Canada. The Site functions as a corporate information hub and a participant inquiry channel. It does not itself host payments or confer enrollment rights; availability is confirmed after a separate enrollment process.

All educational materials and guidance are provided for learning purposes only. We do not provide legal, financial, tax, investment, medical, or human resources advice. Any templates, checklists, or frameworks are examples intended to support professional learning; their application remains your responsibility.

3. Educational and Results Disclaimers

The Site and any linked course materials are intended solely for educational and professional development. Participation in a program does not guarantee employment opportunities, business growth, financial results, promotions, or any particular professional outcome. Outcomes vary based on numerous factors outside our control, including organizational context, implementation effort, and timing. You must evaluate whether information learned through the programs is suitable for your specific workplace and comply with all applicable internal policies and laws when applying it.

4. Acceptable Use

You agree not to misuse the Site. Prohibited activities include, without limitation: (a) scraping, crawling, or data mining; (b) circumventing or attempting to circumvent security features or access controls; (c) introducing malware, ransomware, spyware, or other harmful code; (d) interfering with Site availability or performance; (e) sending spam, unsolicited promotions, or deceptive messages via forms; (f) impersonating any person or entity or misrepresenting your affiliation; (g) using the Site in violation of applicable laws, export controls, or sanctions regimes; and (h) copying, reproducing, or redistributing content without prior written permission, except where permitted by law.

5. Intellectual Property

All content on the Site, including text, graphics, course descriptions, logos, icons, and the overall look and feel, is owned by or licensed to Ile Konsult AS and protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal or organizational evaluation of our educational offerings. Except as expressly allowed by law, you may not copy, modify, adapt, translate, publish, distribute, or create derivative works from any Site content without our prior written consent.

6. Third-Party Services and Links

The Site may reference or link to third-party resources (for example, mapping services or document viewers). We do not control and are not responsible for third-party content, policies, or practices. Accessing any third-party service is at your own discretion and risk. Where a third-party provider processes personal data on our behalf, we address that relationship in our Privacy Policy.

7. Privacy and Data Processing

Our collection and use of personal data submitted through the Site are described in our Privacy Policy. By using the Site or submitting a form, you authorize us to process your information as outlined there, including for the purposes of responding to your request, managing program inquiries, improving content, and complying with legal obligations. 8. No Warranties

The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Ile Konsult AS disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability. We do not warrant that the Site is error-free, secure, or that defects will be corrected. Educational examples, frameworks, and templates are illustrative and may not fit every situation.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Ile Konsult AS and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of revenue, loss of goodwill, loss of data, or business interruption, arising from or related to your use of, or inability to use, the Site or any educational content.

Our aggregate direct liability for any and all claims arising from or relating to the Site shall be limited to the greater of (i) the total amount you paid to Ile Konsult AS for the specific educational service giving rise to the claim in the twelve (12) months preceding the event, or (ii) NOK 1,000. The foregoing limitations apply even if any remedy fails of its essential purpose.

10. Indemnification

You agree to indemnify and hold harmless Ile Konsult AS, its officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Site, or any content you submit through the Site that infringes or violates any law or third-party rights.

11. Force Majeure

We are not liable for any delay or failure to perform resulting from events beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of government, labor disputes, utility failures, internet outages, cyberattacks, denial-of-service attacks, or failures of hosting providers or third-party services.

12. International Use and Service Area

Ile Konsult AS is a company established in Norway with a registered office in Oslo. While our educational programs are available to participants throughout Canada, we make no representation that content on the Site is appropriate or available for use in every jurisdiction. You are responsible for compliance with local laws when accessing or applying any educational materials.

13. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles. The courts of Oslo, Norway, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Site. Mandatory consumer protection rights available under your local law remain unaffected where applicable.

14. Dispute Resolution and Informal Process

Before commencing any legal action, the parties agree to attempt to resolve the dispute informally. You must send a written notice describing the dispute to the contact address in Section 21. If the dispute is not resolved within thirty (30) days after receipt of the notice, either party may pursue legal remedies in the courts specified above. Nothing prevents either party from seeking injunctive or equitable relief to protect confidential information or intellectual property at any time.

15. Termination

We may suspend or terminate your access to the Site at any time and for any reason, including if we reasonably believe that you have violated these Terms. Upon termination, the license granted to you in Section 5 ends immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution) shall survive.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions of the Terms will remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ile Konsult AS regarding your use of the Site and supersede any prior or contemporaneous understandings relating to the Site.

18. Assignment

Ile Konsult AS may assign or transfer these Terms, in whole or in part, to any affiliated entity or in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign or transfer any rights or obligations under these Terms without our prior written consent, and any attempted assignment in violation of this restriction shall be void.

19. No Waiver

No failure or delay by Ile Konsult AS in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy, nor shall any single or partial exercise of any right, power, or remedy preclude any other or further exercise thereof or the exercise of any other right, power, or remedy.

20. Modifications to the Terms or the Site

We may update these Terms from time to time. Material changes will be posted on the Site at least fourteen (14) days before they take effect, unless immediate changes are required by law or to address security or operational issues. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms. We may modify, suspend, or discontinue the Site or any portion of it at any time without liability.

21. Electronic Communications and Notices

You consent to receive communications from us electronically, including emails and notices posted on the Site. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing, consistent with applicable electronic signature laws.
